These terms apply to your use of the Kinect Sports Lab website, app and dashboard, and to any membership or service you purchase from us (“we”, “us”). By creating an account, enrolling or making a purchase, you agree to them.

Accounts and minors

You must give accurate information and keep your login confidential. Many of our athletes are under 18. A parent or legal guardian must create the account, complete enrollment, sign waivers and make payment on a minor’s behalf, and is responsible for the athlete’s use of our services.

Memberships and services

We offer memberships, assessments, lessons, training programs and related services, described on our pricing page. Service descriptions, pricing and availability may change; changes do not affect amounts already paid. In-facility services require an advance reservation and are subject to availability.

Payment and billing

Prices are in US dollars. Annual memberships are a 12-month commitment billed monthly, and you authorize us and our payment processor to charge your payment method on each billing date until the commitment is complete. Payments are processed by a third-party processor; we do not store full card numbers. Taxes are added where required.

Refunds and cancellations are governed by our Refund & Cancellation Policy, and delivery by our Service Delivery Policy.

Assumption of risk and waivers

Baseball training and athletic testing carry an inherent risk of injury. Participation requires completing the waivers presented during enrollment. Our assessments, data and coaching recommendations are for athletic development and are not medical advice; consult a physician about any injury or health condition.

Facility rules

Athletes and guests must follow staff instructions and posted safety rules. We may suspend or end access for conduct that endangers others or damages equipment, in which case fees already paid for the current period are not refunded.

Content, data and intellectual property

The website, reports, programs, video and dashboards are owned by us or our licensors and are provided for your personal use; you may not copy, resell or republish them. You give us permission to use the data, video and measurements captured about an athlete to deliver services and improve our programs. We will not use identifiable photos or video of an athlete in marketing without separate permission. See our Privacy Policy.

Acceptable use

Do not misuse the site, attempt to access other people’s accounts or data, or interfere with its operation.

Disclaimers and limits of liability

Services are provided “as is”, and we do not guarantee particular performance results or outcomes. To the fullest extent the law allows, our total liability for any claim relating to our services is limited to the amount you paid us for the service in question, and we are not liable for indirect or consequential damages. Nothing in these terms limits liability that cannot be limited by law.

Governing law

These terms are governed by the laws of the State of North Carolina, and disputes will be heard in the state or federal courts located in Mecklenburg County, North Carolina.
